Sign the Waiver

Liability waiver & release

Please read this before you sign. It applies to every visit for the next 12 months unless you withdraw it in writing.

1. 1.Acknowledgement of risk

   DigLand Kids is an indoor play space built around a large sand arena with ride-on excavators, diggers, climbing features, and toys, shared with other children of different ages and sizes.

   • Active play carries risks that can't be designed away — slips, trips, falls, bumps, and collisions with other children or equipment.
   • Our team looks after the space and the equipment. We are not a childcare facility and we do not supervise individual children.
   • Sand gets everywhere. It sticks to clothes, hair, and skin, and it comes home with you.
   • I accept these risks on behalf of myself and the children I am signing for.

2. 2.Health and safety

   • Each child I am signing for is in good health, and I know of no condition that makes play unsafe for them.
   • No child in my party has had a fever, vomiting, diarrhoea, or any contagious symptom in the last 24 hours.
   • I will tell a member of our team about any allergy or medical need before we play.
   • I will report any injury, hazard, or unsafe behaviour to staff straight away.

3. 3.Supervision

   DigLand Kids is a parent-supervised play space. Open play is designed for children ten and under.

   • A parent or guardian stays on site and keeps their children in sight for the whole visit.
   • I am responsible for my children's behaviour, including how they treat other children and our equipment.
   • Our team may ask anyone to stop an activity, or to leave, if it puts people at risk.

4. 4.Rules of play

   By signing, I agree that my party will follow the rules posted in the venue, which include:

   • No running, pushing, or rough play.
   • No throwing sand.
   • No food or drink inside the sand arena.
   • Barefoot or socks in the sand — no shoes.
   • Treat the equipment and other families with care.
   • Follow instructions from our team.

5. 5.Release of liability

   In return for being allowed to use DigLand Kids, and to the fullest extent permitted by New Jersey law, I:

   • Release DigLand Kids, its owners, staff, and agents from claims for injury, illness, loss, or damage arising out of our use of the facility, including claims based on ordinary negligence.
   • Accept that this release does not cover gross negligence, recklessness, or intentional misconduct, and does not limit any right that cannot be waived by law.
   • Agree this release binds me, the children I am signing for, and our heirs and representatives.
   • Agree that if any part of this waiver is found unenforceable, the rest still stands.

6. 6.Responsibility for damage

   • I will cover the cost of any damage to the venue or its equipment caused by me or the children I am signing for.
   • For parties, damage caused by guests may be taken from the deposit.

7. 7.Personal belongings

   • I bring my belongings at my own risk. DigLand Kids isn't responsible for items that are lost, damaged, or taken.

8. 8.Food and drink

   • Families booking a party are welcome to bring their own food, cake, and decorations.
   • For open play, food and drink stay in the seating area — never in the sand.
   • I will tell our team about allergies in my party so they can help us plan around them.
